Today on the radio I once again heard the ever overused line “what the founding fathers intended” in a conversation about constitutional law (in this case free speech).
I think it’s time to retire that argument. I believe what those brave men created was a document intended to guide the governance of a nation for the people and by the people. One that would be changed and rechanged as the nation continued to evolve, and whose basic argument was for the right of freedom.
So why do we even care now, 200 plus years later, what they specifically intended regarding particular issues? Didn’t they intend for us to be free enough and smart enough to decide what the constitution best means for us today?
